1. MultiChannel Creative

1.1 The Website is owned and operated by MultiChannel Creative (hereby referred to as ‘MCC’), a division of Desktop Group Ltd, company registration number TBC, based at 52-53 Birchall Street, SK Building, Digbeth, Birmingham, B12 0RP.
1.2 All the content on this Website is owned by MCC.
1.3 As owners of this Website, MCC may, at any time and without the requirement to provide any notice period, amend, update, remove or restrict access to this Website or the content on this Website, without needing to provide just cause.
1.4 As part of our monitoring process, MCC may – occasionally or constantly - collect and analyse anonymous aggregate data relating to site usage and performance.

2. Intellectual Property
2.1 All copyright, trademarks, database right and other intellectual property rights on this Website are owned by MCC or its licensors.
2.2 You may retrieve and view the content on-screen and print out on paper (but not photocopy) or store in electronic format (but not on any server or other device connected to a network) a reasonable amount of the content from this Website for your personal and non-commercial use only.

3.1 This Website may contain hyperlinks to and from 3rd party websites.  MCC is in no way responsible for the availability, accuracy, reliability or content of 3rd party sites.

4. Contracts & Payments

4.1 Clients of MCC will be required to sign a legally binding contract relating to their website development and ongoing campaigns in order to commence the agreement.
4.2 For website development work, a 50% deposit payment will be required in order for MCC to begin the work.
4.3 The remaining 50% payment (following point 4.2 above) will be payable upon completion of the website development work, in order for the website to progress from ‘test’ status to ‘live’ status.
4.4 Payment terms for the above and all other projects and campaigns are agreed between the client and MCC.  Once agreed, late payments may be subject to additional late payment bank charges at the prevailing rate.
4.5 Payments can be made by clients to MCC using credit/debit or bank electronic transfer of funds.

5. Liability
5.1 You agree that the only liability of MCC to you arising out of your use of this Website is for death or personal injury caused by the negligence of MCC or for fraudulent mis-statement made to you by MCC.
5.2 You agree that (to the fullest extent allowed by law) MCC will not be liable to you and / or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to this Website.

6. Restrictions

You may not use this Website to:
6.1 disseminate any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
6.2 transmit material that encourages conduct that constitutes a criminal offense, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

6.4 interfere with any other person’s use or enjoyment of this Website;

8.4 English law governs these Terms & Conditions and only the English courts will decide disputes.
8.5 If any court of competent jurisdiction finds any provision of these Terms & Conditions invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall remain in effect.
8.6 Failure by MCC to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.
8.7 A person who is not a party to these Terms & Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any of the terms and conditions set out in these Terms & Conditions. This shall not affect any right or remedy of a third party which exists or is available apart from that Act.
8.8 MCC shall not be responsible for any breach of these Terms & Conditions caused by circumstances beyond its control.
8.9 The headings in these Terms & Conditions are for convenience only and shall have no legal meaning or effect.
